I’m running for Congress to focus on the issues that matter, and three decisions from the Supreme Court this month matter big time. Here’s what you need to know:
1. They’re still coming for women’s lives.
Last year, Idaho passed a total abortion ban with NO exceptions, not even if the patient’s life is in jeopardy. The Biden administration took this law to court, arguing that the Emergency Medical Treatment & Labor Act (EMTALA) mandates that physicians treat all patients requiring life-saving care, even if the treatment is an emergency abortion.
This week, the justices decided 6-3 to dismiss the case, protecting Idaho women’s right to an abortion in the case of an emergency – FOR NOW. The case will continue in the lower courts, and legal experts believe this relief is only temporary.
The Supreme Court most likely dismissed the case to stop their decision from impacting Republicans in the November election. Once the election’s over, this case will make its way back to SCOTUS.
The only way we’ll stop our far-right justices from sacrificing women for “state’s rights” is if we elect leaders who will fight to restore Roe v. Wade and protect our reproductive rights.
2. Same-sex marriage will be overturned.
The Supreme Court took their first shot at marriage last week when the extreme majority ruled that the U.S. government does not have an obligation to recognize your spousal rights if your partner is from another country.
In a dissenting opinion, Justice Sonia Sotomayor warned that same-sex marriage rights are next.
In 2015, Obergefell v. Hodges gave my best friend and my sister the right to marry the people they love. But it also gave every American the “basic civil right” to a legally-recognized marriage.
Last week’s decision is the first exception to Obergefell, paving the way for same-sex marriage to be overturned next.
3. They just buried our best chance at combating environmental disasters.
In 1984, the Supreme Court ruled that if Congress passes a regulation without specific instructions, then the agency responsible for implementing it has the authority to decide how to do so.
For example, if Congress passes a law requiring quarterly testing of all oil companies’ toxic injection wells, it’s up to the EPA to determine a schedule for testing each site.
This precedent is called the Chevron deference, and it has allowed federal agencies to enforce laws around the environment, energy, food safety, drug testing, workers' rights, education, civil liberties, and the list goes on.
Yesterday, the Supreme Court overruled the Chevron deference in a power grab that gives THE COURTS the authority to decide if or how any modern regulation is enforced.
I’ve told you before how the elite Republican extremists of the 1980s used the Federalist Society to buy our federal courts.
We’ve seen how they have used their power to roll back our rights and leave us vulnerable to corporations and dystopian state governments.
Now, every modern health, safety, and environmental regulation is in their hands, and Big Oil’s best friend in Congress – my opponent Troy Balderson – will do nothing to stop them.
We CANNOT allow Republicans to hold us hostage another two years, especially when Congress could be tasked with rewriting and re-passing the laws that protect our families most.
The extremists on the Supreme Court have threatened or already attacked women’s reproductive rights, voting rights, equal rights, climate action, housing, education, and the list keeps growing.
We have so much work to do to reverse their attacks on our rights and our government, and this election could be our last chance to catch up and reform the courts.
I promise when I’m elected, I will fight to protect my family and yours from corporate interests, extremist judges, and malicious lawmakers who handicap our government and accelerate disaster for political gain.
