They overturned Roe v. Wade. They’ve hinted at overturning same-sex marriage. They agreed to take up Trump’s presidential immunity case.
Whatever the Supreme Court does next, we’re probably screwed.
As a member of Congress, I will always tell you the truth about what’s happening in our country. Today, I’m going to tell you the truth about what’s happened to the Supreme Court.
You’ve probably seen the headlines about conservative justices’ upside-down flags and luxurious gifts. These are valid concerns, but they only touch the surface of the problems with the Court.
In the 1980s, ultra-conservative lawyers and strategists formed The Federalist Society, an organization that claimed to exist to give conservative voices a space on college campuses.
Their real mission was to identify and recruit legal talent aligned with right-wing donors’ interests, mold them, and get them nominated to positions on federal courts.

From there, they could reinterpret the law to push “modern originalism,” a concept supported by the Federalist Society’s founders that says our laws and our culture should reflect life back in 1776.
These guys weren’t just “ultra-conservative.” They were the elite Republican extremists of the 1980s, and today they own two-thirds of the Supreme Court.
When George W. Bush was president, Federalist Society member Brett Kavanaugh – now one of our Supreme Court justices – was in charge of steering him towards nominating other FS members to the federal courts.
Under Donald Trump, every level of the judicial branch was weaponized by the Federalist Society.
On the Supreme Court, the group and its dark-money donors gave us Justices Neil Gorsuch, John Roberts, Brett Kavanaugh, Amy Coney Barrett, Samuel Alito, who is in the news for flying anti-democracy flags at his home and vacation property, and Clarence Thomas, who was caught accepting gifts from and vacationing with a far-right billionaire.
When the Federalist Society’s members and donors bring a case to SCOTUS, guess how the Court votes.
There’s a solution. House Democrats have introduced the Judicial Ethics and Anti-Corruption Act, a code of ethics and standards of conduct that would protect the court from corruption and hold our justices accountable.
The current class of conservative justices on the Supreme Court have threatened or already attacked women’s reproductive rights, voting rights, equal rights, climate action, housing, education, and the list keeps growing.
This month, they’re scheduled to vote on two cases that could DESTROY all water, air, food, and drug protections, forcing Congress to rewrite and re-pass every regulation in existence. I’ll share more on that later.
Republicans aren’t just fear mongering when they say we’re at war. I think they’re projecting, because we are in a sort-of war, aren’t we? But it’s not a cultural war; it’s a legal one. They started it, and they’re winning.
